Subject to the exemptions, any person who makes a request to a public authority for information, must be informed:
The right to access the information held by public authorities can be exercised by anyone, worldwide. The Act is also retrospective. The right to access information comes into effect on 1st January 2005.
October 2003
From October 2003 NHS Public Authorities were required to adopt and maintain a publication scheme setting out how NHS organisations publish the different classes of information held, and whether there was a charge for the information.
What is a Publication Scheme?

What is 'information'?
Information is defined as information recorded in any form. This includes any paper or electronic documentation.
How can a request for information be made?

We will let you know whether or not we hold the information you have requested. If we do, we will supply this information within 20 working days from receipt of the request (subject to certain conditions).
Cost of Information
The charges will vary according to how the information is made available and details can be found within the Publication Scheme. Where a charge is to be made, we will let you know the cost in advance.
A request for information not included within the Publication Scheme can be made from 1 January 2005.
Is the Act Retrospective?
Yes. Information created prior to the Act coming into effect is included.
Exemptions
The Act lists exemptions to the duty to disclose and these are not exhaustive. Please refer to Part 3 of our Publication Scheme for further details. If information is withheld, we will give you the reasons for this decision and also inform you of the right to appeal to the Information Commissioner.
