Logo: Freedom of InformationThe Freedom of Information Act was passed on 30th November 2000. It gives a general right of access to all types of recorded information held by public authorities.

 

Subject to the exemptions, any person who makes a request to a public authority for information, must be informed:

  • whether the public authority holds that information and

  • If that information is held, then it must be supplied, subject to certain conditions.

The right to access the information held by public authorities can be exercised by anyone, worldwide. The Act is also retrospective. The right to access information comes into effect on 1st January 2005.

 

October 2003

 

From October 2003 NHS Public Authorities were required to adopt and maintain a publication scheme setting out how NHS organisations publish the different classes of information held, and whether there was a charge for the information.

 

What is a Publication Scheme?

 

Publication Schemes are guides to what information a public body will publish or intends to publish.  The North Yorkshire and York PCT Publication Scheme is a complete guide to the information we routinely publish and the information is grouped into the following broad categories:

  1. Who we are and what we do.
  2. What we spend and how we spend it
  3. What are our priorities and how are we doing
  4. How we make decisions
  5. Our policies and procedures
  6. The services we offer

Our Publication Scheme has been approved by the Information Commissioner.

 

What is 'information'?

 

Information is defined as information recorded in any form.  This includes any paper or electronic documentation.

 

How can a request for information be made?

 

Requests must:

  1. Be made in writing

  2. State the name and address of the applicant

  3. Describe the information requested.

Response to a Request for Information

 

We will let you know whether or not we hold the information you have requested. If we do, we will supply this information within 20 working days from receipt of the request (subject to certain conditions).

 

Cost of Information

 

The charges will vary according to how the information is made available and details can be found within the Publication Scheme. Where a charge is to be made, we will let you know the cost in advance.

 

A request for information not included within the Publication Scheme can be made from 1 January 2005.

 

Is the Act Retrospective?

 

Yes. Information created prior to the Act coming into effect is included.

 

Exemptions

 

The Act lists exemptions to the duty to disclose and these are not exhaustive. Please refer to Part 3 of our Publication Scheme for further details. If information is withheld, we will give you the reasons for this decision and also inform you of the right to appeal to the Information Commissioner.
