Equality, Diversity and Human RightsPublic Sector Equality Duty 2011

The Equality Act 2010 (the Act) replaced previous anti-discrimination laws with a single Act. It simplified the law, removing inconsistencies and making it easier for people to understand and comply with. It also strengthened the law in important ways, to help tackle discrimination and inequality.

The public sector Equality Duty (section 149 of the Act) came into force on 5 April 2011. The Equality Duty applies to public bodies and others carrying out public functions. It supports good decision-making by ensuring public bodies consider how different people will be affected by their activities, helping them to deliver policies and services which are efficient and effective; accessible to all; and which meet different people’s needs.

Public bodies subject to the specific duties must publish information to show their compliance with the Equality Duty. This means that the information they publish must show that they had due regard to the need to:

  • eliminate unlawful discrimination, harassment and victimisation and any other conduct prohibited by the Act;

  • advance equality of opportunity between people who share a protected characteristic and people who do not share it; and

  • foster good relations between people who share a protected characteristic and people who do not share it.

The Equality Duty is supported by specific duties, set out in regulations which came into force on 10 September 2011. The specific duties require public bodies to publish relevant, proportionate information demonstrating their compliance with the Equality Duty; and to set themselves specific, measurable equality objectives. The PCT will review its equality information between January and April in order to set measurable objectives which can realistically achieved during a significant period of transition.

Organisational Context

NHS North Yorkshire and York is committed to providing high quality, appropriate services that all our population can access fairly. We recognise and value the diversity within our communities and have a responsibility to tackle inequality and discrimination:

  • as an employer, and

  • through our duty to tackle health inequalities and improve health within our local community

We aim to deliver healthcare services that are equitable to everyone regardless of age, disability, race, ethnicity or national origin, gender, religious belief, sexual orientation, domestic circumstances, trade union membership (or non membership), social or employment status.

The data produced for this period includes the organisation was a single legal entity, but with two distinct identities as a commissioning and a Provider organisation. The context will change with effect from 1 February 2012, when the Provider Services move away be managed by a different organisation.

Equality Objectives

The Equality Act 2010 is supported by Specific Duties requiring public bodies to set themselves specific, measurable equality objectives.

The relevant data was published on the public website on 31 January 2012 and NHS North Yorkshire and York has subsequently reviewed its equality information and is set ts equality objectives.

As part of the NHS reorganisation the white paper Delivering Equity and Excellence: Liberating the NHS, the Equality Objectives reflect the need to ensure safe transfer of our services and encourage a culture of delivery of the Equality and Diversity Agenda in new organisations. In view of this, objectives have been set to be realistic and targeted for the transition timetable the organisation must meet in its final year, yet sufficiently broad to support and encourage new organisations to deliver this agenda in the longer term.

Objectives

There are five objectives in two categories as follows:

1. Workforce Data Monitoring

  • Improve our workforce equality data; in particular where data is recorded as undeclared/undefined

  • Better reporting of flexible working arrangements

2. Management Objectives

  • Support processes to encourage the development of the Equality agenda in Clinical Commissioning Groups (CCGs) ensuring CCG Boards have access to local engagement events and in-house expertise where required

  • Clear and transparent transfer of accountability for this agenda in new Clinical Commissioning Services (CSS) and CCG organisations

  • Ensure the public is informed of the NHS local changes and understand these through consultation with stakeholders and groups who represent those with protected characteristics

Information

NHS North Yorkshire and York has already produced a range of information to support transparent arrangements in how it is using equality data to run its business.  This includes annual employment data, public health data and service equality analysis (Equality Impact Assessment).

Employment data

Employment data has generally been published at the end of each financial year recording and monitoring workforce activity for the previous year. For the last financial year this is available in the Annual Report on this page. All of our HR Policies are published on our website. To access them, click here.

It would therefore be normal practice to produce this data as at March 2011. However, in the light of the new duty, the opportunity has been taken to produce updated data for the period April 2011 to October 2011.

Our Objectives as a PCT

  • To achieve health outcomes for the population of North Yorkshire and York that  are consistently within the upper quartile in England.

  • To develop a sustainable financial framework which will provide resources for service development and support infrastructure and contingency once debt has been repaid.

  • To be the employer of choice within the PCT health economy.

  • To engage with public and patients whether through specific programme or locations or through stakeholder or voluntary sector representation.

  • To develop the organisation so that it is ‘fit for purpose’ and prepared for any required change in configuration, particularly in relation to community and mental health services.

We regularly use a range of reporting processes to measure our health outcomes across a range of factors including equality and diversity protected characteristics. The following pages provide information describing the type of data collected and how it is utilised to inform our decision making:
