The Equality Act 2010 (the Act) replaced previous anti-discrimination laws with a single Act. It simplified the law, removing inconsistencies and making it easier for people to understand and comply with. It also strengthened the law in important ways, to help tackle discrimination and inequality. The public sector Equality Duty (section 149 of the Act) came into force on 5 April 2011. The Equality Duty applies to public bodies and others carrying out public functions. It supports good decision-making by ensuring public bodies consider how different people will be affected by their activities, helping them to deliver policies and services which are efficient and effective; accessible to all; and which meet different people’s needs. Public bodies subject to the specific duties must publish information to show their compliance with the Equality Duty. This means that the information they publish must show that they had due regard to the need to:
The Equality Duty is supported by specific duties, set out in regulations which came into force on 10 September 2011. The specific duties require public bodies to publish relevant, proportionate information demonstrating their compliance with the Equality Duty; and to set themselves specific, measurable equality objectives. The PCT will review its equality information between January and April in order to set measurable objectives which can realistically achieved during a significant period of transition. Organisational Context NHS North Yorkshire and York is committed to providing high quality, appropriate services that all our population can access fairly. We recognise and value the diversity within our communities and have a responsibility to tackle inequality and discrimination:
We aim to deliver healthcare services that are equitable to everyone regardless of age, disability, race, ethnicity or national origin, gender, religious belief, sexual orientation, domestic circumstances, trade union membership (or non membership), social or employment status. The data produced for this period includes the organisation was a single legal entity, but with two distinct identities as a commissioning and a Provider organisation. The context will change with effect from 1 February 2012, when the Provider Services move away be managed by a different organisation. The Equality Act 2010 is supported by Specific Duties requiring public bodies to set themselves specific, measurable equality objectives. The relevant data was published on the public website on 31 January 2012 and NHS North Yorkshire and York has subsequently reviewed its equality information and is set ts equality objectives. As part of the NHS reorganisation the white paper Delivering Equity and Excellence: Liberating the NHS, the Equality Objectives reflect the need to ensure safe transfer of our services and encourage a culture of delivery of the Equality and Diversity Agenda in new organisations. In view of this, objectives have been set to be realistic and targeted for the transition timetable the organisation must meet in its final year, yet sufficiently broad to support and encourage new organisations to deliver this agenda in the longer term. Information NHS North Yorkshire and York has already produced a range of information to support transparent arrangements in how it is using equality data to run its business. This includes annual employment data, public health data and service equality analysis (Equality Impact Assessment). Employment data has generally been published at the end of each financial year recording and monitoring workforce activity for the previous year. For the last financial year this is available in the Annual Report on this page. All of our HR Policies are published on our website. To access them, click here. It would therefore be normal practice to produce this data as at March 2011. However, in the light of the new duty, the opportunity has been taken to produce updated data for the period April 2011 to October 2011.
